A New York City law that would allow non-citizens to vote in local elections was deemed unconstitutional by a state appeals court on Wednesday.

The law would have allowed roughly 800,000 green card holders and individuals with federal work authorization living in the Big Apple to vote in the city’s elections, including in mayoral and City Council elections. Democratic and Republican elected officials have been in a drawn-out legal battle over the law, and the court’s ruling Wednesday hands Democrats a defeat.

Thousands of Non-Citizens Are Listed on U.S. Voter Rolls, Watchdog Warns

Tens of thousands of non-citizens have tried or made it onto voter rolls across the U.S. over recent years, according to an election watchdog’s analysis of data from several states.

Non-citizen voters have been found on voter rolls in North Carolina, Pennsylvania, Texas and Maricopa County, Ariz. In Georgia, there were non-citizens who attempted to register to vote but were placed in a pending status because there wasn’t evidence of their citizenship, so they didn’t make it onto the voter rolls.

Vermont Supreme Court Upholds Law Allowing Non-Citizens to Vote in Local Elections

The Vermont Supreme Court ruled in favor of a law permitting noncitizens to vote in local, municipal elections. In 2021, the state Legislature backed bills to change the local charters of Montpelier and Winooski to permit noncitizen voting in local elections. Though Republican Gov. Phil Scott vetoed those measures, the Democratic Legislature overrode his objections, the Associated Press reported.

Colorado Mistakenly Sends Voter Registration Notices to 30,000 Non-Citizens

The Colorado Secretary of State’s Office mailed voter-registration instructions to roughly 30,000 non-citizens living in the state. 

The agency said it is attempting to determine why the registration postcards were sent to people who had non-citizen state driver’s licenses, Colorado Public Radio reported last week.

Immigration and Customs Enforcement (ICE) announced Tuesday that it will officially consider migrants’ US military service before deciding whether to enforce civil immigration actions, such as deportation, against them or their family members.

While ICE has previously recognized US military service as a mitigating factor, the Biden administration’s directive makes consideration of US military service an official agency policy. The department will take into account the non-citizen US veteran’s type of discharge, length of service, and other related factors before deciding to take action against an illegal immigrant and their immediate family members.

Republicans Move to Ban Federal Funds to States, Cities That Allow Non-Citizens to Vote

Sen. Marco Rubio, R-Fla., is leading a coalition of Republicans in Congress to sponsor legislation that would ban federal funding to states or localities that allow foreigners to vote in U.S. elections.

The new legislation, dubbed the Protecting Our Democracy by Preventing Foreign Citizens from Voting Act, was introduced after many liberal municipalities from San Francisco to New York have moved in 2021 to allow non-citizens to cast ballots in local elections

“It’s ridiculous that states are allowing foreign citizens to vote,” Rubio said. “However, if states and localities do let those who are not U.S. citizens to vote in elections, they shouldn’t get U.S. citizen taxpayer money.”
